Renters Reform Act – Student Tenancy Guide
Renters Reform Act – Student Tenancy Guide
The Renters Reform Act introduces major changes to student accommodation across Lancaster and the wider private rental sector. This guide explains what the changes may mean for student tenants, landlords and guarantors, helping you understand your rights and responsibilities more clearly.
The information below is intended as a helpful guide. If you are unsure how the changes affect your tenancy or property, please speak to our team for further guidance.
What is changing?
The Renters Reform Act brings significant changes to how private tenancies are managed. Fixed-term assured shorthold tenancies are expected to be replaced by periodic tenancies, giving tenants more flexibility to leave by serving the correct notice.
Section 21 “no fault” evictions are also being removed, meaning landlords will need to rely on specific legal grounds if they need to regain possession of a property.
Frequently Asked Questions
What is changing under the Renters Reform Act?
The Renters Reform Act introduces major changes to private renting, including the removal of fixed-term tenancies and Section 21 “no fault” evictions. Most tenancies will move to periodic agreements, giving tenants more flexibility.
Can I still be tied into an 11-month student tenancy?
No. Fixed-term agreements are being replaced with periodic tenancies, meaning tenants can leave by giving the correct notice rather than being tied into a full academic year.
How do I give notice under the new rules?
Notice must be provided in writing, usually by email or letter, and should clearly state the intended end date of the tenancy.
How much notice do I need to give?
Tenants are generally required to give at least two months’ notice. This must be submitted correctly and will apply to all tenants in a joint tenancy.
What happens if one housemate wants to leave?
In a joint tenancy, all tenants remain responsible for the rent and obligations. If one tenant wishes to leave, the group may need to arrange a replacement tenant or agree a new tenancy.
What is a Deed of Assignment?
A Deed of Assignment allows one tenant to transfer their responsibilities to another tenant without ending the tenancy. This is often used when a replacement tenant is found.
What is a Ground 4A notice?
Ground 4A is a legal ground that allows landlords to regain possession of student accommodation so it can be re-let to full-time students, provided certain conditions are met.
Will guarantors still be required?
Yes. Most student tenancies will still require a guarantor, who agrees to cover rent payments and tenancy obligations if the tenant is unable to do so.
Can landlords still evict without a reason?
No. Section 21 is being removed, meaning landlords must use valid legal grounds, such as rent arrears, selling the property or another permitted reason.
Will rent increases change?
Rent increases are expected to be limited to once per year and must be fair and in line with market conditions. Tenants may have the right to challenge unreasonable increases.
What happens to my deposit?
Your deposit must still be protected in a government-approved tenancy deposit scheme and returned at the end of the tenancy, subject to fair deductions for rent arrears, damage or cleaning where appropriate.
Can I report issues with my property?
Yes. Tenants have the right to report issues such as damp, mould, leaks, heating problems or safety concerns. Landlords are responsible for ensuring the property remains safe and well maintained.
How should I report repairs?
All repair and maintenance issues should be reported through Fixflo as soon as possible so they can be reviewed and addressed promptly.
Can landlords refuse pets?
Landlords must consider pet requests reasonably and cannot automatically refuse without good reason, although reasonable conditions may still apply.
